Terms of Use

Welcome to Pawsitive Messages. By using the app, you agree to the following terms.

1. Acceptance of Terms

By accessing or using Pawsitive Messages, you agree to be bound by these Terms of Use and our Privacy Policy.

If you do not agree, please discontinue use of the app.

2. Eligibility

You must be at least 13 years old to use Pawsitive Messages.

3. Accounts

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Treat Credits

Pawsitive Messages uses digital credits called "Treats."

• Each message costs 1 Treat.
• Treats may be earned or purchased.
• Treats have no cash value.
• Treat purchases are non-refundable except where required by law.
• Unused Treats are forfeited upon account deletion, suspension, or termination.

5. User Content

You retain ownership of the content you create.

By using the app, you grant us a limited license to:

• Process your content to generate messages
• Store your content in your account
• Review reported content for safety

You agree not to submit content that:

• Is unlawful
• Is abusive or harassing
• Infringes intellectual property rights
• Violates community standards

We reserve the right to remove or restrict access to content that violates these Terms.

6. AI-Generated Content Disclaimer

Pawsitive Messages uses artificial intelligence to generate content. AI-generated messages:

• May be creative, humorous, or unpredictable
• May contain inaccuracies
• May not be appropriate for all audiences
• Should not be relied upon as professional, medical, legal, financial, or therapeutic advice

We do not guarantee accuracy, suitability, or outcomes. Users are solely responsible for reviewing and determining whether to share generated content.

7. Personal Use; Commercial Licensing

Pawsitive Messages is intended for personal, non-commercial use unless you enter into a separate written agreement with Strategic Advantage Solutions, LLC authorizing commercial use.

You may not use the app or its outputs for:

• Resale
• Commercial publishing
• Marketing or advertising campaigns
• Training AI systems
• Creating derivative AI products
• Bulk content generation
• Automated scraping or harvesting

We reserve the right to suspend or terminate accounts engaged in commercial or unauthorized use. We may monitor usage patterns to detect automated, bulk, or commercial activity.

8. Intellectual Property

All app content, branding, software, features, and underlying technology are owned by Strategic Advantage Solutions, LLC.

You may not:

• Copy
• Reverse engineer
• Replicate core functionality
• Create competing services based on this product

Unauthorized use may result in legal action.

9. Suspension and Termination

We may suspend, restrict, or terminate your access at our sole discretion if:

• You violate these Terms
• You attempt to exploit or abuse the platform
• You engage in commercial or automated use
• Your behavior presents risk to other users or the integrity of the service

Termination may result in permanent loss of data and Treat credits.

10. Digital Purchases

Treats are digital goods delivered immediately.

Except where required by law:

• All Treat purchases are final
• No refunds will be issued for unused credits

If purchases are made through Apple App Store or Google Play Store, all payments are processed by the applicable platform provider and are subject to their billing terms.

11. Future Features and Subscriptions

We may introduce subscription services or scheduled message features in the future. Subscription terms and billing policies will be disclosed at the time of purchase.

We reserve the right to modify, suspend, or discontinue features at any time.

12. International Use

The app is operated from the United States. If you access it from outside the U.S., you do so at your own initiative and are responsible for compliance with local laws.

By using the app, you consent to processing and storage of your information in the United States.

13. Your Data Rights

Depending on your location, you may have rights to:

• Access your data
• Request correction
• Request deletion

You may exercise these rights by contacting us at support@pawsitivemessages.com.

We may need to verify your identity before fulfilling requests.

14. Indemnification

You agree to defend, indemnify, and hold harmless Strategic Advantage Solutions, LLC from any claims arising from:

• Your use of the app
• Your violation of these Terms
• Your misuse of AI-generated content
• Content you submit or share

15. No Warranty

The app is provided "as is" and "as available," without warranties of any kind.

16. Limitation of Liability

To the fullest extent permitted by law, Strategic Advantage Solutions, LLC shall not be liable for:

• Indirect, incidental, or consequential damages
• Emotional distress
• Loss of goodwill
• Loss of data
• User misuse of AI-generated content

Your use of the app is at your own risk.

To the fullest extent permitted by law, our total cumulative liability arising out of or relating to your use of the app shall not exceed the greater of:

(a) the total amount you paid to us in the twelve (12) months preceding the claim, or
(b) $100.

We are not responsible for delays, interruptions, or failures caused by events beyond our reasonable control.

17. Automated Processing and Personalization

The app uses automated systems and artificial intelligence to generate content and personalize user experiences.

These systems enhance user experience and do not make legal, financial, medical, or eligibility determinations.

We may also analyze aggregated usage data and study patterns to improve the app and to publish research about general patterns of use. This research does not identify you or your pet. Our handling of this data is described in our Privacy Policy.

By creating an account and using the app, you accept these Terms and our Privacy Policy, including this use of aggregate data. Pets shown publicly in our marketing appear only where the pet parent submitted them to be featured and agreed to the publicity terms described on our PawClub page.

18. Dispute Resolution; Arbitration; Class Action Waiver

Please read this section carefully. It affects your legal rights.

19. Changes to Terms

We may update these Terms at any time. Continued use constitutes acceptance.
